OVERVIEW

Welcome to SQWRIFY! The terms “we”, “us” and “our” refer to SQWRIFY. SQWRIFY operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). SQWRIFY is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. To use our Services or purchase products, you may be asked to provide information such as email, billing, and shipping details. You warrant that all information provided is correct and complete. You are solely responsible for maintaining the security of your account credentials.

SECTION 2 - OUR PRODUCTS & ARTISTIC DISCLAIMERS

We make every effort to provide an accurate representation of our art. However:

  • Color Accuracy: Colors may differ from your screen due to device settings and screen calibrations.

  • Artistic Interpretation: A commission is a bespoke artistic interpretation, not a literal digital recreation. By commissioning a piece, the client accepts the artist’s unique style and creative judgment.

  • Reference Photos: Final detail is dependent on the quality of the reference photo provided.

  • Product Changes: Descriptions and pricing are subject to change without notice. We reserve the right to discontinue any product or limit quantities at any time.

SECTION 3 - PORTRAIT COMMISSIONS & MEDIA

  • Pricing: "Grand Statement" acrylic commissions start from AED 3,000 – 7,000+. Intricate backgrounds are quoted as premium add-ons.

  • Framing: Professional framing is provided only for pastel artworks. Acrylic portraits are delivered as high-quality stretched canvases.

  • Media Nature: Soft pastel is a delicate medium. We are not responsible for any damage occurring after delivery in good condition, especially if the frame is opened or mishandled.

SECTION 4 - PAINT PARTIES & WORKSHOPS

  • Bookings: Must be paid in full at the time of reservation.

  • Cancellations: If the client cancels within 48 hours of the event, the full payment is non-refundable.

  • Artist’s Right to Cancel: We reserve the right to cancel due to unforeseen emergencies (force majeure). A full refund or rescheduled date will be offered.

  • Liability: We provide aprons; however, acrylic paint is permanent. We are not liable for paint damage to personal clothing. For private events, the client is responsible for protecting floors/furniture.

  • Conduct: In accordance with UAE law, we reserve the right to remove any guest exhibiting disruptive or unsafe behavior without a refund.

SECTION 5 - ORDERS

When you place an order, you are making an offer to purchase. Your order is not accepted until confirmed by us. We reserve the right to decline any order. Purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK]. You warrant that purchases are for personal use and not for commercial resale.

SECTION 6 - PRICES AND BILLING

The price charged will be the price in effect at the time the order is placed. Posted prices do not include taxes, shipping, or customs charges. You represent that the credit card information provided is true and that you are authorized to use it.

SECTION 7 - SHIPPING AND DELIVERY

We are not liable for delays caused by carriers or customs. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 8 - INTELLECTUAL PROPERTY & CULTURAL SENSITIVITY

  • Ownership: All content, images, and designs are owned by SQWRIFY and protected by copyright laws. You must not reproduce or distribute any material without written consent.

  • Copyright for Commissions: The artist retains all reproduction rights for promotional use. A Privacy Fee (NDA) applies for exclusive private commissions.

  • UAE Compliance: We reserve the right to decline any request that is politically sensitive, religiously offensive, or violates UAE modesty norms.

SECTION 9 - OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools (like AR viewers or framing apps) "as is" without warranties. We are not responsible for the content or accuracy of third-party websites linked through our Services.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

SQWRIFY is powered by Shopify. You acknowledge that any sales are made directly with SQWRIFY. Shopify is not responsible for any aspect of sales, including injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify from all claims arising from your transactions with SQWRIFY.

SECTION 11 - FEEDBACK

If you submit reviews or suggestions, you grant us a perpetual, royalty-free license to use and distribute that feedback for any purpose. We may monitor or remove feedback that we deem unlawful or offensive.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any typographical errors or inaccuracies related to pricing and descriptions, and to cancel orders if information is inaccurate, even after an order is submitted.

SECTION 13 - PROHIBITED USES

You may not use the site for any unlawful purpose, to infringe on intellectual property, or to transmit malicious code. We reserve the right to terminate your access for violating these terms.

SECTION 14 - TERMINATION

We may terminate this agreement at any time. Sections such as Intellectual Property, Feedback, Limitation of Liability, and Governing Law shall survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES

The Services and all products are provided 'as is' and 'as available' without any representation or warranties of any kind, either express or implied. We do not guarantee your use of the service will be uninterrupted or error-free.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent provided by law, in no case shall SQWRIFY or Shopify be liable for any injury, loss, claim, or any direct, indirect, or consequential damages of any kind arising from your use of the Services or any products procured.

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold SQWRIFY and Shopify harmless from any claims or demands, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms or your violation of any law.

SECTION 18 - SEVERABILITY & ENTIRE AGREEMENT

If any provision is determined to be unlawful or void, the remaining provisions shall remain enforceable. These Terms constitute the entire agreement between you and SQWRIFY.

SECTION 19 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. You consent to the jurisdiction of the courts located in the UAE.
